MAKING AN OFFER
Once the right property has been identified, the process moves from instinct to structure.
In Marbella's market, a well-prepared offer carries weight. Beyond price, it should define the full terms of purchase giving both parties the clarity needed to proceed with confidence.
A considered offer outlines:
Purchase price and cost structure
Inclusions within the sale (furniture, fixtures, inventory)
Proposed payment schedule
Preferred completion timeline
Having funds, documentation, and timelines in place before an offer is made ensures your position is credible, competitive, and taken seriously.
RESERVATION
Following acceptance, the property is secured through a reservation agreement.
A fee, typically around 1% of the purchase price is transferred to a client account, and the property is formally withdrawn from the market, usually for a period of around 14 days. This creates the space needed for due diligence and progression toward exchange.
While the reservation agreement is not fully binding, the fee is generally non-refundable. It signals genuine intent, pauses competing interest, and protects your position while the process moves forward.
CASA Moderna and your legal advisors oversee each step during this period, ensuring the transaction progresses with precision and control.
DUE DILIGENCE
Due diligence is where commitment is tested and clarity is established.
Commencing once the reservation is in place, this stage involves a thorough legal review of the property typically completed over approximately 14 days to verify all material facts before exchange.
This includes:
Confirming legal title and ownership
Verifying the absence of debts, charges, or encumbrances
Ensuring all utilities and outstanding obligations are settled
Reviewing planning permissions and regulatory compliance where future works are intended
Each element is examined without assumption. CASA Moderna works in close coordination with your legal team throughout, maintaining oversight and ensuring nothing is overlooked.
TECHNICAL INSPECTION
Prior to exchange, a qualified independent inspector assesses the property's structure, fabric, and installed systems from foundations and roof to electrical, plumbing, and climate installations.
This is not a formality. It provides an objective assessment of the property's condition, giving you a complete picture before you commit and, where relevant, a basis for further negotiation.
TITLE DEED & LAND REGISTRY
For buyers not requiring financing, the process moves directly to completion once due diligence is finalised with no requirement to sign a private purchase contract.
Completion takes place before a notary, where the title deed (Escritura) is signed, the remaining balance is transferred, and legal ownership formally passes to you. Notary and Land Registry fees apply and vary according to the property value and transaction complexity.
Following completion, you receive the title deed and Nota Simple confirming your ownership. The Land Registry is updated, and utility providers are notified of the change.
This is the moment the process becomes a home.
